Official Contest Rules

MULTIPLE ENTRIES WILL NOT IMRPOVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES WHO ARE AT LEAST EIGHTEEN (18) YEARS OF AGE AT THE TIME OF ENTRY. NOT AVAILABLE IN ARIZONA, MARYLAND, COLORADO OR NORTH DAKOTA.

This Campaign is open only to those who complete the entry steps outlined in The Post and Section 5 below as of the date of entry. MULTIPLE ENTRIES WILL NOT IMRPOVE YOUR CHANCES OF WINNING. The Campaign is only open to legal residents of the United States who are eighteen (18) years and older at the time of entry and is void where prohibited by law. NOT AVAILABLE IN ARIZONA, MARYLAND, COLORADO OR NORTH DAKOTA. Employees of Gosh Enterprises, Inc./Bibibop LLC, their parent companies, affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Campaign. The Campaign is subject to all applicable federal, state, and local laws and regulations.

3. Agreement to Rules:

By submitting an entry pursuant to Section 5, the Entrant (“You”) agrees to be fully and unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Bibibop LLC as final and binding as it relates to the content and outcome of this Campaign.

Entries will be accepted starting at 11:59 a.m. EST on June 10, 2024 and ending at 11:59 p.m. on July 2, 2024. All entry steps outlined in The Post and Section 5 below must be completed by 11:59 p.m. EST on June 30, 2024. Late entries will not be accepted.

5. How to Enter:

To qualify as an Entrant, you must by complete the steps outlined below:

1. Post a photo on your PUBLIC Instagram account with a BIBIBOP beverage.
2. Include #BIBIBOPSummerSips in your caption.
3. Tag @bibibopasiangrill in your photo.
4. Entrants must follow @bibibopasiangrill on Instagram.
5. Entrants must have (or make a FREE) BIBIBOP Rewards account.
6. Be creative and have fun!

NOTE: Entries containing content deemed by Bibibop LLC, in its sole discretion, to be violent, sexually explicit, or otherwise objectionable, or which violate Instagram’s terms and conditions of use, will be disqualified and ineligible for consideration. Bibibop LLC reserves the right to reject any entry for any reason at its sole discretion.

6. Prizes:

The first-place entrant of the Campaign will receive a $100 BIBIBOP Reward Credit to their Bibibop rewards account (“First Place Prize”). The second-place entrant will receive a $50 BIBIBOP Reward Credit to their Bibibop rewards account (“Second Place Prize”). The third-place entrant will receive a Free Bowl Reward Credit to their Bibibop rewards account (“Third Place Prize”). The Prize(s) are nontransferable. All prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of The Winner(s). No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted.

9. Winner Selection and Notification:

Three total Entrants will be selected as the finalists by the following criteria:

• Clear focus on the Bibibop drink as the main subject
• Unique, outside-the-box perspective or concept
• Bibibop drink and logo are clearly visible
• Follows all rules and requirements of the contest
• Colors, styling, environment align with Bibibop branding
• Captures essence of “Take Care Always” philosophy
• Conveys a fun, vibrant, healthy sentiment

The finalists’ submissions will be posted as separate posts on the official BIBIBOP Instagram account. The submission with the most likes on BIBIBOP’s Instagram by 11:59 p.m. EST on July 2, 2024 will receive the First Place Prize. The post with the second most likes on BIBIBOP’s Instagram by 11:59 p.m. EST on July 2, 2024 will receive the Second Place Prize. The post with the third most likes on BIBIBOP’s Instagram by 11:59 p.m. EST on July 2, 2024 will receive the Third Place Prize. Winners will be selected by the highest like count under the supervision of Bibibop LLC. The Winners will be notified by 12:15 a.m. on July 3, 2024 via direct message through Instagram.

The use of automated liking software, payment for likes, exchange for compensation pertaining to likes, automated script liking, liking from fake or secondary accounts, or any other means of like manipulation as determined by BIBIBOP at its sole discretion is prohibited. Any individual or coordinated likes in violation of this provision, whether or not directly undertaken by the Entrant, may result in entry disqualification.

Bibibop LLC shall have no liability for the failure by Winner(s) to receive notices due to spam, junk email, or other security settings or for the Winners’ provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within five (5) days from the time award notification was sent, the prize may be forfeited, and an alternate Winner selected. Receipt by Winner of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT BIBIBOP LLC’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

10. Additional Terms & Conditions:

Bibibop LLC reserves the right, in their sole discretion, to cancel, terminate, modify or suspend the Campaign should virus, bug, non-authorized human intervention, fraud, or other cause beyond either company’s control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. In such case, Bibibop LLC may select the Winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Bibibop LLC. Bibibop LLC reserves the right, in their sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or violates these the Rules.  Bibibop LLC has the right, in their sole discretion, to maintain the integrity of the Campaign, to void entries for any reason. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Campaign may be a violation of criminal and civil laws. Should such an attempt be made, Bibibop LLC reserve the right to seek damages to the fullest extent permitted by law.

11. License:

By submitting a video or image to the BIBIBOP Summer Sips Challenge pursuant to Section 5, you hereby grant Bibibop LLC and its affiliated companies a worldwide, royalty-free, non-exclusive, transferable license to use, reproduce, distribute, publicly display, modify, and create derivative works of the Submission for any and all purposes, including but not limited to, posting on Sponsor’s official social media accounts, without further compensation to you.

You represent and warrant that you have all necessary rights, permissions, and consents to grant the license set forth herein. You further acknowledge and agree that Bibibop LLC shall have no obligation to utilize or exploit the Submission, and Bibibop LLC use of the Submission is at its sole discretion.

You understand and agree that Bibibop LLC may, in its sole discretion, edit or modify the Submission for any purpose, and you waive any right to inspect or approve any such modifications or uses. Additionally, you release and discharge Bibibop LLC, its agents, employees, and affiliates from any and all claims, demands, or causes of action arising out of or in connection with the use of the Submission, including any claims for defamation, invasion of privacy, or infringement of moral rights.

You acknowledge that Bibibop LLC may attribute your name or username to the Submission if it is used, but Bibibop LLC is under no obligation to do so. Furthermore, you agree that the license granted herein shall survive the termination or expiration of the Contest or these terms and conditions.

12. Limitation of Liability:

By entering, You agree to release and hold harmless Bibibop LLC, Instagram and each of their parent companies, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such Entrant’s participation in the Campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.

13. Disputes:

THIS CAMPAIGN IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF OHIO, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Campaign, participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the State of Ohio having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to any damages or awards whatsoever, including compensatory, punitive, incidental, or consequential damages, including reasonable attorney’s fees. Participant further waives all rights to have damages multiplied or increased.
